These Terms of Service (“Terms”) are a legal agreement between you and Civil Entrepreneur LLC, which operates Sunday Tally (“Sunday Tally,” “we,” “us,” or “our”), a ministry analytics platform that helps churches track attendance, volunteers, and giving. By creating an account or using Sunday Tally, you agree to these Terms. If you are agreeing on behalf of a church or other organization, you represent that you are authorized to bind that organization to these Terms. If you do not agree, do not use the service.
You must be at least 18 years old and able to form a binding contract to use Sunday Tally. The service is intended for church staff, leaders, and volunteers.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Each church account is owned by the person or organization that registers it. You may invite team members and assign them roles. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use of your account.
As between you and us, your church's data belongs to you. You grant us a limited license to host, process, and display that data solely to provide and improve the service and as described in our Privacy Policy. We do not sell your data or use your ministry data for advertising. You are responsible for the data you enter and for having the necessary rights to provide it. You can export or delete your data at any time as described in the Privacy Policy.

Paid plans are billed in advance on a recurring monthly basis through our payment processor. By subscribing, you authorize us to charge your payment method for the applicable fees, including any add-ons or per-campus charges you select. You may cancel at any time; cancellation takes effect at the end of your current billing period, and you will retain access until then. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial periods. We may change our prices or plans, and will give you advance notice of any increase that would affect your subscription; continued use after the change takes effect constitutes acceptance of the new pricing.
Sunday Tally offers optional AI features. AI-generated analytics, charts, and responses may be incomplete or inaccurate and are provided for convenience only. You are responsible for reviewing and verifying any AI output before relying on it for decisions.
Sunday Tally, including its software, design, and trademarks, is owned by us and our licensors and is protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service; they do not transfer any ownership of the platform to you.
We work to keep Sunday Tally available and reliable, but we do not guarantee that the service will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue features from time to time. We may also perform maintenance that temporarily limits availability.
The service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will meet your requirements, that it will be uninterrupted or error-free, or that any data, reports, or AI output will be accurate or reliable. You use the service, and rely on any results, at your own risk.
To the maximum extent permitted by law, in no event will Sunday Tally, Civil Entrepreneur LLC, or its owners, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the service, even if we have been advised of the possibility of such damages. Our total liability for all claims relating to the service will not exceed the greater of (a) the amount you paid us for the service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Sunday Tally, Civil Entrepreneur LLC, and its owners and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the service, your data, or your violation of these Terms or applicable law.
You may stop using the service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or use the service in a way that may cause harm or legal exposure to us or others. Upon termination, your right to use the service ends; provisions that by their nature should survive (including data ownership, disclaimers, limitation of liability, and indemnification) will survive.
These Terms are governed by the laws of the State of Oklahoma, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts located in Oklahoma, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you by email or within the app. Your continued use of Sunday Tally after changes take effect constitutes acceptance of the new Terms.
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
